厦门大学法学院简介

厦门大学是中国较早开办高等法学教育的院校之一。1926年6月，厦门大学设立了法科，下设法律学、政治学、经济学三系。1930年2月学校改科为院，法科改为法学院。尔后经历数次院系调整，目前的法学院是在原法律系的基础上组建而成。经过三十余年的发展，厦门大学法学院已汇集了一批优秀的中青年骨干教师，并形成了一支结构合理、实力雄厚、富有创新意识的学术梯队。在2005年、2009年教育部学位与研究生教育发展中心组织的法学学科评估中，厦门大学法学院的办学实力在全国法学院校中均排名第八。厦门大学法学院入选“卓越法律人才教育培养计划”，拥有应用型、复合型法律职业人才教育培养基地和涉外法律人才教育培养基地。

历史沿革

法学院是厦门大学历史较为悠久的主要学院之一。1926年6月，厦门大学设立法科，下设法律学、政治学、经济学三系。1930年2月，厦门大学改科为院，法科改为法学院。1934年6月，法学院与商学院合并为法商学院。1937年底，法商学院中的法科停办。

1940年秋，原福建大学法学院划归厦门大学，与厦门大学商学院中的经济系合并，组成厦门大学法学院，同时复办法律学系。1950年9月，厦门大学文学院、法学院合并为文法学院。1952年学校撤销学院建制。1953年全国院系调整，厦门大学法律学系再次停办。

1979年8月，国家教育部批准厦门大学设立法学专业，法律学系再次复办。1984年12月，厦门大学与福建省联合办学，成立了政法学院，下设法律学系、政治学与行政学系、哲学系。1998年9月，政法学院更名为法学院，下设法律学系、政治学与行政学系，哲学系归入人文学院。1999年4月，法学院成为具有管理实体性质的学院。

法学院是2003年11月在法律学系的基础上组建的，原隶属于法学院的政治学与行政学系归入公共事务学院。

师资力量

自1979年厦门大学复办法学专业以来，经过三十余年的发展，厦门大学法学院已汇集了一批优秀的中青年骨干教师，并形成了一支结构合理、实力雄厚、富有创新意识的学术梯队。全院现有法学专任教师81人，其中教授36人，副教授21人。具有博士学位的教师66人，约占教师总数的81.5%。在师资队伍中，3人为中央“千人计划”入选者，1人为国家“百千万人才工程首批第一、二层次人才”、1人入选教育部“跨世纪优秀人才培养计划”、6人入选教育部“新世纪优秀人才支持计划”、2人入选国家知识产权局“百千万知识产权人才工程百名高层次人才培养计划”。

秉承“自强不息、止于至善”的校训，坚持以人才培养为本，走学术建院之路，厦门大学法学院已形成较为鲜明的学科建设和办学特色。学院现拥有法学博士后科研流动站、法学一级学科博士学位授予权和硕士学位授予权、以及1个法律专业硕士(JM)学位点。国际法学为国家重点学科，自1993年开始一直是中国国际经济法学会挂靠单位和会长所在机构。国际经济法学科的综合实力位居全国前列，国际投资法研究方向已具有相当的国际影响，联合国贸发会议于2010年遴选国际投资法“全球15所法学院领航项目”(G-15

Project)成员，厦门大学法学院成为中国大陆唯一入选的院校。民商法学、宪法学与行政法学、经济法学为福建省重点学科。“国际经济法与台港澳法研究”、“国际经济法与海洋法研究”和“国际法律制度、两岸法律问题及和平发展研究”先后获准列入国家“211工程”第一期、第二期和第三期重点建设项目，法学学科获准列入“985工程”建设项目。近年来，厦门大学法学院立足于国际法及民商法等特色和优势学科，不断充实和提升其他后发学科的教学科研力量，整个学科建设呈现出了有梯次的均衡发展态势。在2005年、2009年教育部学位与研究生教育发展中心组织的法学学科评估中，厦门大学法学院的办学实力在全国法学院校中均排名第八。

厦门大学法学院的学生辩论队享誉海内外，在Willem
C.Vis国际商事模拟辩论赛(英文)、Jessup国际法模拟法庭辩论赛(英文)和国际人道法模拟法庭辩论赛(英文)等三项全国性和国际性专业大赛中屡创佳绩。参赛队员曾于2006、2011年两度获得Jessup国际法模拟法庭辩论赛(华盛顿)诉状世界冠军，2012年获得Willem
C.Vis国际商事模拟辩论赛(维也纳)反方诉状世界季军。

厦门大学法学院现设有法理学、宪法与行政法学、民商法学、刑法学、经济法学、诉讼法学、国际法学、法律史学等8个教研室，此外还建立了国际经济法研究所、罗马法研究所、海洋政策与法律研究中心、经济法研究中心、国际税法与比较税制研究中心等研究机构，并成立了法律硕士教育中心和教学实验中心。厦门大学法学院定期连续出版的学术刊物有《厦门大学法律评论》(CSSCI学术数据来源集刊)、《国际经济法学刊》(CSSCI学术数据来源集刊)、《中国海洋法学评论》、《东南司法评论》、《罗马法与现代民法》及《国际关系与国际法学刊》等。

学院规模

厦门大学法学院具有良好的办学条件，法学院大楼占地10000多平方米，基建面积8235平方米。不仅拥有独立的办公楼和教学楼，而且建设有标准化的案例教学讨论室和多媒体教室以及教师工作室。厦门大学图书馆拥有丰富的法学图书资料，并引进开发了若干种重要的中西文电子期刊数据库(包括LEXIS-NEXIS数据库)。1998年，学校还专门设立了厦门大学图书馆法学分馆，该分馆已被批准为联合国资料托存图书馆。

突出贡献

厦门大学法学院是国内最早开展国际经济法教学和科研的单位之一。经过20多年的创业与发展，国际经济法学科综合实力已位居全国前列，尤其是在国际经济法基本理论、国际投资法、国际经济条约与国际经济组织、国际税法及国际经济争端解决等方面，取得了一批在海内外有影响的学术成果。

厦门大学法学院民商法学科建设起步较早，研究范围涵盖了民商法的各主要领域，并已取得了丰硕的科研成果。该学科以民商法理论为基础，密切跟踪中国改革开放和市场经济体制建设的实践，形成了特色鲜明的研究方向。在民法典研究、罗马法研究等领域取得了较为突出的成果，部分研究成果在国内处于领先地位。

A brief introduction to the Law School of Xiamen University

Xiamen University is one of the earliest institutions to offer higher law education in China. In June 1926, Xiamen University established a law department with three departments of law, political science and economics. In February 1930, the school was changed to a school, and the law department was changed to a law school. After that, it has undergone several adjustments of colleges and departments, and the current law school is formed on the basis of the original law department. After more than 30 years of development, the Law School of Xiamen University has gathered a number of excellent young and middle-aged backbone teachers and formed an academic echelon with reasonable structure, strong strength and innovative consciousness. In the legal discipline evaluation organized by the degree and Postgraduate Education Development Center of the Ministry of Education in 2005 and 2009, the school-running strength of Xiamen University Law School ranked eighth among the national law colleges and universities. The Law School of Xiamen University has been selected into the “Education and training Program for Outstanding legal talents”. It has an applied and compound legal professional education and training base and a foreign-related legal talent education and training base.

Historical evolution

Law School is one of the major colleges with a long history in Xiamen University. In June 1926, Xiamen University established a law department with three departments of law, political science and economics. In February 1930, Xiamen University changed its subject to a college, and the law department to a law school. In June 1934, the Law School and the Business School were merged into the Law Business School. At the end of 1937, the law department in the Law Business School was closed.

In the autumn of 1940, the former Law School of Fujian University was transferred to Xiamen University and merged with the Economics Department of Xiamen University Business School to form Xiamen University Law School and resume the Law Department at the same time. In September 1950, the School of Arts and Law of Xiamen University merged into the Grammar School. The school abolished the establishment of the college in 1952. In 1953, colleges and departments across the country were adjusted, and the Department of Law of Xiamen University was suspended again.

In August 1979, the Ministry of Education approved the establishment of a law major in Xiamen University, and the law department resumed. In December 1984, Xiamen University and Fujian Province jointly established the School of political Science and Law, which consists of the Department of Law, the Department of political Science and Administration, and the Department of philosophy. In September 1998, the School of political Science and Law changed its name to the School of Law, with the departments of Law, Politics and Administration under it, and the Department of philosophy as the School of Humanities. In April 1999, the Law School became a college with the nature of a management entity.

The School of Law was established in November 2003 on the basis of the Department of Law, and the Department of political Science and Administration formerly affiliated to the School of Law was subsumed into the School of Public Affairs.

Teachers’ strength

Since the resumption of the major of law in Xiamen University in 1979, after more than 30 years of development, the School of Law of Xiamen University has gathered a number of excellent young and middle-aged backbone teachers, and formed an academic echelon with reasonable structure, strong strength and innovative consciousness. There are 81 full-time law teachers in the hospital, including 36 professors and 21 associate professors. There are 66 teachers with doctoral degrees, accounting for about 81.5% of the total number of teachers. Among the teaching staff, three are selected for the central “Thousand talents Plan”, one for the first batch of first-and second-level talents of the National 10 million Talent Project, and one for the Cross-Century Talent training Plan of the Ministry of Education. 6 were selected into the Ministry of Education’s “New Century Outstanding Talent support Plan”, and 2 were selected into the State intellectual property Office’s “100 High-level talents training Plan of the 10 million intellectual property Talent Project”.

Adhering to the motto of “continuous self-improvement, stop at the best”, adhere to talent training-oriented, take the road of academic construction, Xiamen University Law School has formed a relatively distinct discipline construction and school-running characteristics. The college now has a postdoctoral research station in law, the right to grant doctorates and master’s degrees in first-tier disciplines of law, and a master’s degree in law (JM). International law is a national key discipline, which has been the affiliated unit and president of the China Society of International Economic Law since 1993. The comprehensive strength of the discipline of international economic law ranks in the forefront of the country, and the research direction of international investment law has considerable international influence. In 2010, UNCTAD selected the pilot Project of 15 Global Law Schools of International Investment Law (Gmur15).

The C.Vis International Business moot debate Competition (English), the Jessup International Law moot Court debate Competition (English) and the International Humanitarian Law moot Court debate Competition (English) have achieved good results in three national and international professional competitions. The contestants won the Jessup International Law moot Court debate Competition (Washington) pleadings world champion twice in 2006 and 2011, and won the Willem in 2012.

The School of Law of Xiamen University now has 8 teaching and research departments, including jurisprudence, Constitution and Administrative Law, Civil and Commercial Law, Criminal Law, Economic Law, procedural Law, International Law, legal History, etc. In addition, it has established research institutions such as the International Institute of Economic Law, the Roman Law Institute, the Center for Marine Policy and Law, the Center for Economic Law, and the Center for International tax Law and Comparative Taxation. And set up a master of law education center and teaching experiment center. The academic journals published regularly by the Law School of Xiamen University include Xiamen University Law Review (CSSCI academic data Source Collection), International Economic Law (CSSCI academic data Source Collection), China Marine Law Review, Southeast Judicial Review, Roman Law and Modern Civil Law and International Relations and International Law Journal.

College scale

The Law School of Xiamen University has good conditions for running a school. the Law School Building covers an area of more than 10000 square meters and the infrastructure area is 8235 square meters. It not only has independent office and teaching buildings, but also has standardized case teaching discussion rooms, multimedia classrooms and teachers’ studios. The library of Xiamen University has a wealth of law books and materials, and has introduced and developed several important databases of Chinese and western electronic periodicals (including LEXIS-NEXIS database). In 1998, the school also set up a law branch of the Xiamen University Library, which has been approved as a United Nations depository library.

Outstanding contribution

The Law School of Xiamen University is one of the earliest units to carry out international economic law teaching and scientific research in China. After more than 20 years of entrepreneurship and development, the comprehensive strength of international economic law has been in the forefront of the country, especially in the basic theory of international economic law, international investment law, international economic treaties and international economic organizations, international tax law and the settlement of international economic disputes. A number of influential academic achievements have been made at home and abroad.

The discipline construction of civil and commercial law in the School of Law of Xiamen University started early, the research scope covers all the main fields of civil and commercial law, and has achieved fruitful scientific research results. Based on the theory of civil and commercial law, this discipline closely follows the practice of China’s reform and opening up and the construction of the market economic system, and has formed a distinctive research direction. Outstanding achievements have been made in the study of civil code, Roman law and other fields, and some of the research results are in a leading position in China.
